Welcome to Vibes and Vistas, a website controlled, operated and provided by Vibes and Vistas (“We,” “Us,” or “Vibes and Vistas”). For the purposes of these terms and conditions, the contents of which define the rights, responsibilities, and duties of our readers, visitors, and users, the “Vibes and Vistas network” refers to our websites (vibesnvistas.com and vibesandvistas.com), and magazine (the Vibes and Vistas Magazine).
By using the Vibes and Vistas network, you agree to comply with and be bound by all of the following terms and conditions.
1. ABOUT US
Vibes and Vistas aims to discover and publish the work of Korean visual artists and photographers (“Creatives”). We publish content (“Vibes and Vistas generated content”) across the Vibes and Vistas network in the form of articles, posts, interview features, and editors’ picks. Said content may include the written, audio, and visual content submitted to us by Creatives with whom we collaborate (“user generated content”).
2. USER GENERATED CONTENT
2.1 Creatives are invited to submit content and materials (“user generated content”) to us in a variety of forms, including but not limited to: text, artwork, images, photographs, and audiovisual materials for publication anywhere across the Vibes and Vistas network.
2.2 Upon sending us their content, Creatives grant Vibes and Vistas a perpetual, royalty-free, worldwide, and non-exclusive license to use, copy, adapt, reproduce, distribute, and publish the entirety or any part of their content across the Vibes and Vistas network.
2.3 As most written content is submitted to us in Korean, Creatives grant Vibes and Vistas and its editing team the right to translate, transcreate, and publish the content in question at their discretion without further notice for the purpose of content localization and differentiation as long as it is in line with the original intent and context of the user generated content.
2.4 It is often necessary to reformat user generated content to suit the style of our magazine and/or websites. In this case, Creatives grant Vibes and Vistas the right to reformat the size and dimensions of their content at their discretion without further notice.
2.5 Creatives also permit Vibes and Vistas the right to incorporate your submitted content in any subsequent works that appear across the Vibes and Vistas network, including any media, marketing, and promotional materials. In this circumstance, the copyright of said content belongs to Creatives, and Vibes and Vistas will always attribute the content accordingly.
2.6 When submitting their content, Creatives agree to the following terms and conditions:
2.6.1 All submitted content must be the original work of the Creatives and all Creatives must own the copyright and any other applicable rights necessary for said content to be published by Vibes and Vistas.
2.6.2 All submitted content must not be defamatory, obscene, threatening, offensive, in breach of any intellectual property right, law, or regulation.
2.6.3 Creatives agree to indemnify Vibes and Vistas in full against any third party liabilities, claims, costs, loss, or damage incurred as a result of publishing the content that they submitted to us. Creatives also agree to indemnify Vibes and Vistas against any alleged intellectual property right violations in relation with their work as featured across the Vibes and Vistas network.
2.6.4 Creatives agree that Vibes and Vistas have the right to remove their content from the Vibes and Vistas network at any time without prior notice or liability to them.
2.6.5 Creatives agree that we may share their identity to any third party who claims that their submitted content is in breach of intellectual property right or any other law or regulation.
2.7 Please note that Vibes and Vistas will never claim ownership of any of the content submitted to us by the Creatives, nor do we guarantee the inclusion of their content after receiving their submission.
2.8 Creatives who do not agree to the terms set out above should refrain from submitting their content to us.
3. VIBES AND VISTAS GENERATED CONTENT
3.1 We are the owner or the licensee of all intellectual property rights across the Vibes and Vistas network. As the visitor or reader of content across the Vibes and Vistas network (“user”, “you”), we grant you a limited, temporary, revocable, and non-exclusive license to access, browse, and use the Vibes and Vistas network for your personal and strictly non commercial use.
3.2 Before accessing, browsing and/or using the Vibes and Vistas network, you agree to the following terms and conditions:
3.2.1 You agree to comply with all relevant laws and regulations.
3.2.2 You agree to never use, reproduce, duplicate, copy, sell, re-sell, modify, render accessible all or any part of our content without prior written consent. This means that you agree to never republish all or any part of our content on another website or in another medium without our written permission. 6. ADVERTISEMENTS AND SPONSORSHIPS
6.1 Certain parts of the Vibes and Vistas network contain advertising and sponsorship. As we offer ad creation and promotion services to Korean based brands and sponsors, said brands and sponsors may submit advertising and promotional materials to us exclusively in Korean. At this point, Vibes and Vistas reserves the right to translate and transcreate Korean materials into English for advertising and sponsorship purposes anywhere across the Vibes and Vistas network. 6.2 It is the sole responsibility of the advertisers and sponsors to guarantee that all material submitted for inclusion across the Vibes and Vistas network adheres to all relevant laws and regulations. Vibes and Vistas is not responsible for said material and any issues must be addressed to the advertiser or sponsor in question.
7. PROMOTIONS AND COMPETITIONS
7.1 We may occasionally hold competitions and/or other promotional events across the Vibes and Vistas network. Any such competitions and/or promotional events will be subject to additional terms and conditions as specified and made available at the time.
8. INDEMNIFICATION
8.1 Vibes and Vistas refuses responsibility or liability of infringement or violation of copyright that may arise regarding a Creative’s work after it has been published across the Vibes and Vistas network, nor do we assume responsibility or liability for any breach of any intellectual property right on the part of the Creative who submitted it.
8.2 We assume no legal responsibility for the financial, material, and emotional harm that may occur due to the publication of content across the Vibes and Vistas network.
8.3 You agree to indemnify, defend and hold harmless Vibes and Vistas for any losses, costs, liabilities, and expenses regarding your use of or inability to use the Vibes and Vistas network, your violation of these terms and conditions or any third party, or your violation of any relevant laws, regulations, and codes regarding your use of the Vibes and Vistas network.
9. APPLICABLE LAWS AND JURISDICTION
9.1 In accessing, browsing, and using the Vibes and Vistas network, you agree to comply with the laws, regulations, and codes of the Republic of Korea regarding online conduct. You also agree that the laws of the Republic of Korea shall govern these terms and conditions.
9.2 You agree that the jurisdiction of any claim or dispute with Vibes and Vistas shall be the Republic of Korea.
9.3 The Vibes and Vistas network is controlled, operated, and administered by Vibes and Vistas from the Republic of Korea. If you choose to access the Vibes and Vistas network from a location outside of the Republic of Korea, you are responsible for compliance with all local laws and regulations.
10. MODIFICATION OF TERMS AND SERVICES
10.1 Vibes and Vistas reserve the right to change these terms and conditions at any time without prior notice. We ask that you check this page from time to time to familiarize yourself with said changes. 2. 사용자 생성 콘텐츠
2.1 아티스트는 회사 네트워크 출판에 사용되는 자료를 글, 작품, 이미지, 사진 및 시청각 콘텐츠 (이하 “사용자 생성 콘텐츠”) 등의 형태로 회사에 제출할 수 있습니다.
2.2 아티스트는 회사에 사용자 생성 콘텐츠를 제출함으로써, 회사 네트워크를 통해 해당 콘텐츠의 전체 또는 일부를 사용, 복사, 수정, 복제, 배포, 게시 및 출판할 수 있는 영구적이고 로열티 없는 비독점 글로벌 라이센스를 부여합니다.
2.3 아티스트가 제출하는 대부분의 사용자 생성 콘텐츠가 한국어인 관계로, 사용자 생성 콘텐츠의 본 의도 및 내용에 부합하는 한 아티스트는 회사와 그 에디팅팀이 콘텐츠 현지화와 차별화를 목적으로 아티스트에게 별도의 통지 없이 해당 콘텐츠를 창조적으로 번역, 게시 및 출판할 수 있는 권한을 부여합니다.
2.4 아티스트의 사용자 생성 콘텐츠를 당사의 매거진이나 웹사이트의 스타일에 맞게 재조정해야 하는 경우, 아티스트는 회사가 아티스트에게 별도의 통지 없이 해당 콘텐츠의 크기나 치수를 재조정할 수 있는 권한을 부여합니다.
2.5 아티스트는 회사 네트워크를 통한 모든 매체, 마케팅 및 홍보 등의 추후 작업을 위해 회사가 아티스트의 사용자 생성 콘텐츠를 사용할 수 있는 권한을 부여합니다. 이 경우, 해당 콘텐츠의 소유권은 언제나 아티스트에게 귀속하고, 회사는 해당 아티스트의 원작권을 표시합니다.
2.6 아티스트는 회사에 사용자 생성 콘텐츠를 제출함으로써 다음 약관에 동의하게 됩니다.
2.6.1 제출되는 모든 콘텐츠는 아티스트의 원저작물이어야 하며, 아티스트는 회사가 해당 콘텐츠를 게시 및 출판하는 데 필요한 저작권 및 기타 권리를 소유해야 합니다.
2.6.2 제출되는 모든 콘텐츠는 타인의 명예를 훼손하거나, 음란, 위협 또는 공격적이어서는 안 되고, 그 어떠한 지적 재산권, 법률 또는 규정을 위반하여서도 안 됩니다.
2.6.3 아티스트는 회사에 제출한 콘텐츠를 게시 및 출판한 결과 회사에게 발생하는 제3자의 책임이나 주장, 비용, 손실 또는 손해 등을 온전히 배상하는 데 동의합니다. 아티스트는 또한 회사 네트워크에 걸쳐 소개되는 해당 작업과 관련한 모든 지적 재산권 위반 혐의로 인해 회사에게 초래하는 피해를 온전히 보상하는 데 동의합니다.
2.6.4 아티스트는 회사가 사전 통지나 책임 없이 언제나 회사 네트워크에서 해당 콘텐츠를 제거할 권리가 있다는 데 동의합니다.
2.6.5 아티스트가 제출한 사용자 생성 콘텐츠가 지적 재산권 또는 타 법률 및 규정을 위반한다고 주장하는 제3자에게 회사가 아티스트의 신원을 공유할 수 있다는 데 동의합니다.
2.7 회사는 아티스트의 사용자 생성 콘텐츠에 대한 소유권을 결코 주장하지 않을 뿐더러, 아티스트로부터 제출받은 사용자 생성 콘텐츠를 회사 네트워크에 게재한다는 보장을 드리지 않습니다.
2.8 위에 명시된 조건에 동의하지 않는 아티스트는 사용자 생성 콘텐츠 제출을 삼가해주시기 바랍니다.
3. Vibes and Vistas 생성 콘텐츠 (이하 “회사 생성 콘텐츠”)
3.1 회사는 해당 네트워크에 걸친 모든 지적 재산권의 소유자 또는 라이센스 사용자입니다. 회사 네트워크의 방문자 및 독자 (“이용자”)가 개인적이고 비상업적인 용도로 해당 네트워크를 접속, 검색 및 사용하고자 하는 경우에 한해, 회사는 이용자에게 제한적, 일시적, 비독점적인 라이센스를 부여합니다.
3.2 이용자가 회사 네트워크를 접속, 검색 및 사용하기 전에, 다음 약관에 동의해야 합니다.
3.2.1 이용자는 모든 관련 법률 및 규정을 준수하는 것에 동의합니다.

6.1 회사 네트워크의 특정 부분에는 광고와 협찬이 포함되어 있습니다. 당사가 한국 기반 브랜드 및 의뢰자에게도 광고 제작 및 홍보 서비스를 제공하는 관계로, 해당 브랜드 및 의뢰자는 당사에 한국어로만으로도 광고 및 홍보 자료를 제출할 수 있습니다. 이에 대해 당사는 회사 네트워크 전체에 걸쳐 광고 및 협찬을 목적으로 해당 한국어 자료를 영어로 창조적으로 번역할 수 있는 권리를 소유합니다. 관련 추가 문의는 contact@vibesnvistas.com 으로 주시기 바랍니다.
6.2 광고주와 의뢰자는 Vibes and Vistas 네트워크에 게재할 목적으로 회사에 제출하는 모든 자료가 모든 관련 법률 및 규정을 준수하도록 보장할 책임이 있습니다. 회사는 해당 자료에 대해 책임을 지지 않으며, 모든 책임은 해당 광고주 또는 의뢰자에게 있습니다.

8.2 회사는 당사 네트워크 콘텐츠 게재 및 출판으로 인해 발생할 수 있는 재정적, 물질적, 정서적 손해에 대해 법적 책임을 지지 않습니다.
8.3 이용자의 회사 네트워크의 사용 또는 사용 불가능, 이용자의 본 약관 및 조건 위반, 또는 이용자의 회사 네트워크 사용과 관련한 해당 법률 및 규정 위반 등으로 인해 발생하는 손실, 비용, 책임과 관련해 이용자는 당사를 배상, 방어 또는 면책하는 것에 동의합니다.
